Ocean carriers, alone or working together, may make service contracts with shippers. Each contract must be filed confidentially with the Federal Maritime Commission, except contracts about bulk cargo, forest products, recycled metal scrap, new assembled motor vehicles, waste paper, or paper waste. Contracts must say the origin and destination port ranges, the origin/destination areas for through intermodal moves, the commodities, the minimum volume, the line‑haul rate, how long the contract lasts, the service promises, any liquidated damages for failure, and any other essential terms the Commission requires. When filed confidentially, a short public summary listing origin/destination port ranges, commodities, minimum volume, and duration must be published in tariff form. “Dock area” and “within the port area” mean what the applicable collective bargaining agreement says. If a carrier is covered by a collective bargaining agreement, a labor organization can ask in writing whether the carrier is responsible for certain dock or port work (movement of cargo on the dock or to/from rail cars; intraport carriage assignments; carriage between a container yard and an adjacent rail yard; container freight station and container maintenance/repair at the dock). The carrier must answer in a reasonable time. That answer is required only if a valid collective bargaining agreement exists and is not an admission that the work is covered. Disputes about coverage are handled under the agreement and the National Labor Relations Act. Unless the parties agree otherwise, the only remedy for a contract breach is a court action, and any dispute forum can’t be run by a controlled carrier or by the government that owns or controls the carrier.
