People can send complaints about charges by a common carrier to the Federal Maritime Commission, and the Commission must accept them. Complainants must include bill of lading numbers and invoices and can add other helpful documents. The Commission must quickly investigate whether the charge follows sections 41104(a) and 41102. The carrier gets a chance to give more information and must prove demurrage or detention fees are reasonable under 46 CFR 545.5 (or successor rules). If a charge is illegal, the Commission must order refunds and can impose a civil penalty under section 41107. If the carrier is a non-vessel-operating common carrier, the Commission will decide whether that carrier or another party is responsible and may subject them to refunds or penalties.
