§4704 Removal of Abandoned Barges

Summary

The Secretary can remove an abandoned barge, but must follow steps first. If the owner or operator can be found, the Secretary must send a certified-mail notice saying the barge will be removed at the owner’s or operator’s expense and telling them about the penalty under section 4703. If the owner cannot be found, the Secretary must publish a warning in a notice to mariners and in the county’s official journal saying the barge will be removed at the owner’s expense. The United States and its employees are not responsible for damage claims from that removal. The owner or operator must pay the government’s removal costs, and the barge itself can be used to cover those costs. After giving the required notice, the Secretary can ask for sealed bids, award a contract that may make the barge and its contents belong to the contractor, and require the contractor to give a removal plan. Removal may start 30 days after the notice steps are finished.
