§50113 Use and Performance Reports by Operators of Vessels

Summary

The Secretary of Transportation can require operators of vessels that take part in foreign waterborne trade with the United States to file reports, records, or accounts about how the vessel is used and how it performs. Those filings must be signed, verified, and submitted when and how the Secretary's rules say. If an operator does not file a required report, they owe a $50 civil penalty for each day of the violation, and that penalty becomes a legal claim (a lien) against the vessel. The government can sue the vessel in a U.S. district court where it is found to enforce the lien, and the Secretary may reduce or cancel any penalty.
