If the Secretary of Transportation certifies you, you must get reemployment rights and other benefits like those given to reserve members of the U.S. armed forces when they are called to active duty. You must apply for that certification no later than 45 days after you finish the period of employment described below. Within 20 days after getting your application, the Secretary must decide two things: whether you worked on a ship that was either (1) in the National Defense Reserve Fleet and was being used or activated under section 57100(b), (2) requisitioned or purchased under chapter 563, or (3) owned, chartered, or controlled by the U.S. Government and used by the Government for war, armed conflict, a national emergency, or maritime mobilization needs (including training or testing); and whether, during that work, you had a valid license, certificate of registry, or merchant mariner’s document issued under chapter 71 or 73. If both answers are yes, the Secretary must certify you. That certification counts the same for reemployment rights and benefits as the certificate described in section 9(a) of the Military Selective Service Act (50 U.S.C. 3808(a)).
