The Secretary must make a vessel’s owner or operator sign an operating agreement before the vessel can be put into the Fleet. Within 60 days after the law change, the Secretary must offer any existing contractor an extension of its current operating agreement through September 30, 2040, using the kinds of terms allowed under this chapter. An existing contractor has 120 days to accept the extension. If the contractor does not agree, the Secretary may award the agreement to an applicant who is eligible for operating agreements for fiscal years 2016 through 2040. The Secretary can also make new operating agreements for applicants who meet the requirements, following military priorities set by the Secretary of Defense. Applicants must be given at least 30 days to apply. After considering Defense needs, priority goes to U.S. citizens under section 50501. The Secretary cannot approve an application without the Secretary of Defense’s consent and must either sign the agreement or give a written reason for denial. The Secretary may not award agreements that require payments under section 53106 for more than 60 vessels in any one fiscal year.
