Title 46 › Subtitle V — Merchant Marine › Part C — Financial Assistance Programs › CHAPTER 532 — CABLE SECURITY FLEET › § 53202
Create a Cable Security Fleet of two active, commercially viable, privately owned U.S.-documented cable ships to meet national security needs. The Secretary, working with the Operating Agency, must include only vessels that provide commercial cable services, are 40 years old or younger when added (unless waived), are judged suitable for national security, and are commercially viable. A ship must be U.S.-documented or its owner must plan and be eligible to get U.S. documentation when an Operating Agreement is made. Owners and operators must meet one of four citizenship/management rules: owned and run by U.S. citizens; owned by a U.S. citizen or U.S. citizen trust and chartered to a documentation-eligible operator with U.S. control and certifications and required federal notices; owned and run by a defense contractor that meets special security rules and provides notices; or owned by a documentation-eligible person and chartered to a U.S. citizen. A non-U.S.-documented vessel may get a U.S. inspection certificate if it is classed by the American Bureau of Shipping or another accepted society, follows the prior flag state’s international rules, and that state enforces those rules. The Secretary and the Operating Agency can jointly waive the age limit if it is in the national interest, the vessel and network are economically viable, and no other suitable vessels or operators are available.
