The Secretary of Transportation can provide insurance and reinsurance under this law for certain ships, cargo, and related items. That includes American vessels (even ones being built), some foreign vessels if they are owned by a U.S. citizen or are working in U.S. waterborne commerce or doing water transportation or services the Secretary finds important for national defense or the U.S. economy. It also covers cargo on those vessels (including mail), cargo owned by U.S. citizens or residents, cargo imported, exported, or sold under contracts that put war-risk loss on a U.S. person, and cargo moved between U.S. ports. The Secretary may also insure advances and other ship disbursements, freight and passage money, personal effects of people on the ship, loss of life, injury, or detention by an enemy after capture for someone on the ship, and usual statutory or contractual liabilities of the ship, owner, or charterer. When deciding about a foreign vessel, the Secretary must look at the ship’s traits, how it is used, and how the owner or charterer manages it. Insurance that covers personal liabilities (like the items above about people on board) can include non-war risks if the Secretary thinks that is appropriate.
