The Secretary of Transportation must set a single stated value for hull insurance when a vessel is totally lost. That stated value must leave out any national defense features paid for by the United States Government. The value also cannot be higher than what would have been paid if the vessel had been requisitioned under chapter 563 when the insurance attached. The insured has 60 days after the insurance starts or after the Secretary sets the value (whichever is later) to reject that value and pay premiums based on a different value they name. If the insured does not reject it, any claim cannot be more than the stated value. If the insured rejects it, they get a tentative advance of 75 percent of the stated value and may sue the United States to get a court decision on the proper compensation under chapter 563. If a court decides a different value, premiums are adjusted to match that decision.
