The Secretary can suspend section 55102 for goods in foreign trade when they move between barges the owner/operator certifies are fit for vessel carriage and that are owned or leased by the same owner/operator. It does not apply to moves between the continental U.S. and noncontiguous areas where coastwise laws apply. A foreign-flag vessel is covered only if the Secretary, using information from the Secretary of State, finds the foreign government gives reciprocal privileges to U.S. vessels.
