On written application, the Secretary of Transportation may change an essential vessel’s obligations and arrange its maintenance if, after any review, the Secretary finds three things: running the ship on its assigned service or route would be illegal under the Neutrality Act of 1939 (22 U.S.C. 441 et seq.) or would make it unavailable for national defense and commerce; the ship cannot lawfully be used in other foreign or domestic trade except temporarily or in an emergency under section 56503(b)(5); and the owner is not or will not be earning a reasonable return on the capital used because of those limits. Any changes stay in effect only while those conditions continue.
