Carriers must not give lower joint or proportional rates for people or goods moved under subtitle IV of title 49 to or from a U.S. territory, possession, or a foreign port by a water carrier in foreign trade than they charge for the same trip wholly inside the United States, unless the ship is documented under U.S. law. If the Secretary of Transportation finds that U.S.-documented ships are not providing enough service to those ports, the Secretary tells the Surface Transportation Board, and the Board can pause that rule for rail rates to or from those ports under stated terms. If the Secretary later certifies enough U.S.-documented service, the Board can end the pause.
