Ships must get clearance from the Secretary of Homeland Security before leaving a U.S. port in certain cases. Both U.S. and foreign vessels need clearance to go to a foreign port, to another U.S. port (U.S. vessels only if they carry foreign goods not yet entered), or to go outside the territorial sea to visit a hovering vessel or to receive or deliver goods there. The Secretary can make rules on how to get clearance, what papers or electronic data to send, allow early clearance if the owner posts a bond and finishes requirements within a time set by the Secretary (no more than 4 business days), and allow clearance at places that are not designated ports of entry under conditions the Secretary sets.
