Title 46 › Subtitle VI — Clearance, Tonnage Taxes, and Duties › CHAPTER 605 — DISCRIMINATING DUTIES AND RECIPROCAL PRIVILEGES › § 60502
An extra duty of 10 percent of the goods’ value must be charged on some imports, on top of any other taxes. It applies to goods brought in a non-U.S. ship unless the ship has the same right to enter U.S. ports and pay the same charges, or the ship is owned only by U.S. citizens and becomes documented as a U.S. vessel after entering a U.S. port. It also applies to items made in a foreign country not next to the U.S. but shipped from a neighboring country, unless they come in as ordinary retail sales. If the extra duty is not paid, the goods and the ship can be seized and kept by the U.S. government.
