§70506 Penalties

Title 46 › Subtitle Subtitle VII— Security and Drug Enforcement › Chapter 705— MARITIME DRUG LAW ENFORCEMENT › § 70506

Last updated Apr 5, 2026|Official source

Summary

Breaking the drug rules in paragraph (1) of section 70503(a) brings criminal penalties under the Comprehensive Drug Abuse Prevention and Control Act (see 21 U.S.C. 960), and repeat offenders face the stronger punishments in 21 U.S.C. 962. Trying or planning to break section 70503 gets the same penalties as actually doing it. If someone on a vessel under U.S. jurisdiction is found, after written notice and a hearing, to have knowingly or intentionally had a controlled drug (per 21 U.S.C. 812), the Secretary can fine that person up to $5,000 for each violation and must notify them in writing. The Secretary will decide the fine by looking at how serious the act was, the person’s blame, past offenses, ability to pay, and other relevant facts. A civil fine is not a criminal conviction but can be used as proof of possession if needed. Violating paragraph (2) or (3) of section 70503(a) can bring fines under 18 U.S.C. 3571, up to 15 years in prison, or both.

(3)Assessment of a civil penalty under this subsection shall not be considered a conviction for purposes of State or Federal law but may be considered proof of possession if such a determination is relevant.
