The government can take and keep property that is used, or meant to be used, to commit or help commit certain maritime drug crimes. Those take-and-keep rules follow the same federal drug-forfeiture law. Signs that a vessel was made or used for smuggling can be treated as proof of intent and can let authorities seize the boat even if no drugs are found. Such signs include altering the boat to hide from detection (low profile, hidden compartments, extra or illegal tanks, oversized engines, heat- or radar-reducing materials, camo paint, or fake registration); having gear, crew, or cargo that do not match the boat’s stated purpose; carrying way more fuel, food, or supplies than needed; running without required lights; refusing to stop or answering authorities or giving false information; drug residue on the boat, items, or people; using substances to hide residue; or finding drugs in the water near the boat in a way that suggests smuggling.
