The Secretary who runs the department with the Coast Guard may give people or organizations, including public agencies, private companies, or nonprofits, the power to approve containers and designs and put safety approval plates on them. Before doing this, the Secretary must make rules saying how to pick them, what duties and records they must keep, and how the Secretary will review their work. Those given the power must let the Secretary inspect their records on request. They may not assess or collect penalties for violations of the Convention, this law, or the Secretary’s orders, and they may not issue detention or similar orders. The Secretary must publish each delegate’s name and address, the duties given, and how long the delegation lasts. The Secretary can take back the power at any time.
