If a container is under an order not to be moved and the owner, agent, or custodian is told about that order but does not act quickly and reasonably to stop the move, they can be fined up to $5,000 for each container moved. Each day the container stays in service while the order is in effect is a separate violation. After the person is given notice and a chance for a hearing, the Secretary of the department that runs the Coast Guard will decide and collect the fine. The Secretary must consider how serious the violation was, the dangers involved, and the person's past violations. The Secretary can reduce or settle a fine. If the fine is not paid, the case will be sent to the Attorney General to collect in an appropriate U.S. district court.
