The Commission must charge regulatory fees to cover the costs of the work listed in section 156(a), but only when and only in the total amounts that Congress provides in Appropriations Acts. Each fiscal year the Commission sets fee rates to try to collect the needed amount. It must adjust the fee schedule yearly to reflect changes in how many units must pay and to meet the required total. The Commission may round fees to the nearest $5. It can also change fees to reflect staff time in its bureaus and offices and factors tied to the benefit to the payer, but it cannot change the total amount to be collected for the year. Government and nonprofit entities, amateur radio licensees under part 97 (47 CFR part 97), and noncommercial radio or TV stations are not required to pay. The Commission may also exempt anyone if collecting the fee would cost more than the fee itself. Fees go into the account that pays for the section 156(a) activities. Any fees collected above the Congress-approved total for a year must be sent to the Treasury general fund to reduce the deficit.
