After a full hearing, whether because of a complaint or because the Commission started an investigation on its own, the Commission can decide that a carrier’s prices, classifications, rules, or business practices now are or will be against the law. The Commission can then set the fair charges and the maximum or minimum amounts to charge, and order the carrier to stop the unlawful practices and follow the new rules and classifications. Anyone — a carrier or its officers, agents, receivers, trustees, or lessees — who knowingly disobeys such an order must pay $12,000 for each offense. Each separate violation is a separate offense, and each day a violation continues counts as another offense.
