Anyone, a city or state government, or a state agency can file a short complaint with the Commission if a common carrier (for example, a transportation or communications company) breaks the law. The Commission will send the complaint to the carrier and give it a set time to fix the problem or answer in writing. If the carrier does not fix it, the Commission must investigate, and it cannot dismiss a complaint just because the filer had no direct loss. For investigations about charges, classifications, rules, or practices, the Commission must issue a final order within 5 months after the complaint is filed. For cases started before November 3, 1988, the order must be issued within 12 months after that date. Final orders may be appealed under section 402(a).
