Title 47 › Chapter 5— WIRE OR RADIO COMMUNICATION › Subchapter II— COMMON CARRIERS › Part I— Common Carrier Regulation › § 223a
Online platforms covered by the law must set up, within one year after May 19, 2025, a way for a person (or someone allowed to act for them) to tell the platform about an intimate photo or video that shows them and was posted without their permission, and to ask the platform to take it down. The takedown request must include a physical or electronic signature, enough detail to find the photo or video, a short statement that the person believes it was posted without consent, and contact information. The platform must have a clear, easy-to-read notice explaining how to make a request. If the platform gets a valid request, it must remove the intimate image as soon as it can and no later than 48 hours, and try to remove known identical copies. A platform that removes content in good faith will not be legally liable even if the image later turns out not to be unlawful. If a platform fails to follow these rules, the Federal Trade Commission can enforce the law and apply the same penalties and remedies it uses under the FTC Act, including against nonprofits.
