If a ship leaves or tries to leave a U.S. harbor in violation of these rules, or a U.S. ship sails outside a harbor in violation of them, it must pay $5,000 to the U.S. government. The government can collect that money in court. Each illegal departure or attempted departure is a separate offense, and for a U.S. ship each day it sails in violation counts as a separate offense. If the captain of a U.S. ship knowingly fails to follow or to enforce rules about equipment, crew, watches, or radio service, the captain must pay $1,000 to the U.S. government.
