Title 47 › CHAPTER 5 — WIRE OR RADIO COMMUNICATION › SUBCHAPTER V–A — CABLE COMMUNICATIONS › Part II — Use of Cable Channels and Cable Ownership Restrictions › § 533
Cable companies must not hold certain wireless-TV licenses or run satellite master-antenna TV service separately inside the same area where they already provide franchised cable service. The Commission must allow any such services a company already owned on October 5, 1992. The Commission can also allow other exceptions if needed so big parts of a franchise area can get video programming, and the rule does not apply where a cable operator faces effective competition as described in section 543(l). The Commission may make rules about people who own both cable systems and other mass media in the same community. States or local franchising authorities cannot ban someone from owning a cable system just because they own other media, but they can stop a person from owning another cable system in the same area or block a buy that would reduce competition. States or franchising authorities may own cable interests, but they must not control program content on those systems except for educational or government channels, and any editorial control must be handled by a separate entity. Within one year after October 5, 1992, the Commission must start rulemaking to limit how many subscribers a person can reach, how many channels a related video programmer can occupy, and to consider limits on distributors making programming. The Commission must make rules that protect fair access to programming, prevent favoritism, consider market structure and benefits, stay flexible, avoid blocking rural service, and protect diverse, high-quality programming. Interests held on July 1, 1984, are preserved to the extent held then. "Media of mass communications" has the meaning given in section 309(i)(3)(C)(i).
