Title 47 › CHAPTER 5 — WIRE OR RADIO COMMUNICATION › SUBCHAPTER V–A — CABLE COMMUNICATIONS › Part III — Franchising and Regulation › § 548
Promote competition and more choices in the market for TV channel distribution by stopping unfair or deceptive actions that block a distributor from getting satellite cable or satellite broadcast programming to customers. The Federal Communications Commission must issue rules within 180 days after October 5, 1992 that say exactly what behavior is banned. The rules must stop cable operators who own or control satellite vendors from improperly influencing sales, bar unfair price or delivery discrimination (but allow reasonable rules for credit, quality, cost differences, economies of scale, and certain exclusive deals), forbid practices that keep distributors from getting programming for areas not served by a cable operator as of October 5, 1992, and ban exclusive contracts in areas that are served by a cable operator unless the Commission finds the contract is in the public interest after weighing effects on local and national competition, competition from other technologies, investment in new programming, programming diversity, and the contract length. The ban on exclusives in served areas ends 10 years after October 5, 1992 unless the Commission finds it still needed in the last year. A distributor harmed by illegal conduct can bring a complaint to the Commission. The Commission can order remedies, including setting prices, terms, and conditions, must provide expedited reviews, can get contracts and documents, and can penalize frivolous complaints. Rules also apply to common carriers that provide video. Contracts made on or before June 1, 1990 are mostly exempt, but renewals after October 5, 1992 are not. Definitions (one line each): “satellite cable programming” — as defined under section 605, excluding satellite broadcast programming; “satellite cable programming vendor” — a maker or wholesaler of that programming; “satellite broadcast programming” — broadcast TV retransmitted by satellite when not retransmitted by the broadcaster or with its consent; “satellite broadcast programming vendor” — a fixed service satellite carrier under section 119 of title 17.
