Title 49 › SUBTITLE I — DEPARTMENT OF TRANSPORTATION › CHAPTER 1 — ORGANIZATION › § 118
Create an Office of Multimodal Freight Infrastructure and Policy inside the Department of Transportation. The Office will carry out the national multimodal freight policy (see section 70101), run and oversee certain freight grant programs, share information between public and private groups, lead research to improve freight movement, help cities and States build freight skills, work with other Federal agencies, and do other duties the Secretary assigns. The Office must develop and manage the national freight strategic plan (section 70102) and the National Multimodal Freight Network (section 70103), help with State freight plans and give guidance (section 70202), run multimodal freight grants (including those under section 117 of title 23) and set application rules, help set up State freight advisory committees (section 70201) and multi-State compacts (section 70204), and give freight data input to the Bureau of Transportation Statistics. Definitions: “Department” = Department of Transportation; “Freight Office” = the new office; “Secretary” = Secretary of Transportation. An Assistant Secretary for Multimodal Freight will lead the Office. The Assistant Secretary must be nominated by the President and confirmed by the Senate and have freight experience. They report to the Under Secretary for Policy and run the Office’s staff and work with DOT modal agencies. The Secretary may move related offices or functions into the Freight Office and may eliminate offices that are duplicative if doing so won’t break other legal duties and will improve efficiency. The Secretary must make sure the Office has enough staff and funding and may transfer positions and funds from consolidated or eliminated offices, with the option to move funds back if needed. The Department must post Office information and program rules on its website and may create a clearinghouse of tools. Not later than 1 year after enactment, and then at least every 180 days until requirements are met, the Secretary must report to the Senate Commerce Committee and House Transportation Committee on programs, status, staff numbers, any consolidations or eliminations and reasons, actions taken, and any legislative recommendations. The Office does not change other laws or other agencies’ legal responsibilities. Funding is authorized as needed; actions under consolidation and staffing are subject to appropriations.
