The Board must write a report after every proceeding it holds, whether the Board started it or someone filed a complaint. It must give a copy to each party. The report must explain what the Board found, what it decided, and the Board’s order. If the Board awards damages, the report must say the facts that support that award. The Board may publish reports for public use, and a published report counts as evidence of what it says. When the Board, one of its members, or a person or group it designates takes action about a rail carrier, the written statement of that action (for example, a report, order, decision, vote, notice, letter, policy, or regulation) must list the official title of who acted, the name of every person who took part, and each person’s vote or position. If someone did not take part, the statement must say so. Anyone who took part can add their own views to the statement. The statement must also be made available to the public under section 552(a) of title 5.
