Title 49 › SUBTITLE II — OTHER GOVERNMENT AGENCIES › CHAPTER 13 — SURFACE TRANSPORTATION BOARD › SUBCHAPTER II — ADMINISTRATIVE › § 1325
Creates a Railroad-Shipper Transportation Advisory Council made up of 19 people. Fifteen of them are to be picked by the Chairman of the Board within 60 days after December 29, 1995, after rail carriers and shippers make recommendations. Members must be U.S. citizens who are not full-time federal employees. Nine senior executives are the voting members and decide Council actions by majority vote; a majority of those nine is a quorum. Of the nine voters, at least four must represent small shippers and at least four must represent Class II or III railroads. Six others serve as nonvoting advisers (three from Class I railroads and three from large shipper groups). The Secretary of Transportation and Board members are nonvoting ex officio members and may name alternates. Members serve three-year terms, except five of the first appointees serve one year and five serve two years as set by the Chairman. Vacancies are filled the same way. No one may serve more than two back-to-back terms. The voting members elect the Chair and Vice Chair; the Chair runs the Council and issues its reports. Members are not paid for service but may get travel or council expenses if requested and money is approved. The Council may raise private funds and must try private funding before asking federal agencies, explaining in writing why private money would be a conflict or impractical. The Chair can request staff, information, or help from federal agencies. The Council must meet at least twice a year and can invite other agency heads when issues affect them. The Council advises the Secretary, the Board Chairman, and Congressional committees on rail policy, focusing on small shippers and small railroads (topics include car supply, rates, competition, and claims), coordinates on grain car matters, and seeks private-sector fixes. It must send an annual report for each fiscal year to the Secretary and Chairman within 90 days after the fiscal year ends, and those officials must include their views or comments.
