The Secretary and the Board have authority over services a freight forwarder provides when the transportation happens in the United States and is between: (1) a place in one State and a place in another State, even if part of the trip is outside the United States; (2) two places in the same State if the trip goes through a place outside that State; or (3) a place in the United States and a place outside the United States. They do not have authority under this rule when the freight forwarder uses transportation provided by an air carrier covered by part A of subtitle VII of this title.
