Title 49 › Subtitle SUBTITLE IV— INTERSTATE TRANSPORTATION › Part B— MOTOR CARRIERS, WATER CARRIERS, BROKERS, AND FREIGHT FORWARDERS › Chapter 137— RATES AND THROUGH ROUTES › § 13704
Allows a motor carrier that moves household goods under the authority of subchapter I of chapter 135 to set a price based on a written, binding estimate. That price must be offered the same to all shippers and must not be predatory. Also lets carriers offer a rate that guarantees pickup and delivery at the times written in the contract and provides a penalty or per diem if they miss those times. Fees for that guarantee can vary by option. Before offering a guaranteed rate, the Secretary may require the carrier to also keep a non‑guaranteed rate in effect for the same service.
