Decides who must pay truck freight charges when goods are sent to a consignee who is only an agent and does not own the goods. If the delivering carrier is told in writing before delivery that the consignee is an agent (not the owner) and, if the goods might be redirected, the name and address of the actual owner, then the agent only has to pay the charges that are billed at delivery. The agent will not have to pay extra charges found later. If the agent only pays the delivery bill, then the shipper or, when the goods are redirected, the actual owner must pay any extra charges no matter what the bill of lading or contract says. If an agent redirects the goods and they are later refused or abandoned at the final stop, the actual owner must pay all charges if the agent gave the carrier the agent notice and the owner’s name and address. If the consignee gives wrong owner information, the consignee must pay the extra charges.
