The Secretary can require a motor carrier that, under subchapter I of chapter 135, uses vehicles it does not own under an agreement with someone else to do four things: put the agreement in a signed writing that states how long it lasts and what the carrier will pay; keep a copy of the agreement in each vehicle while it applies; inspect the vehicles and get liability and cargo insurance; and control and operate the vehicles to meet the Secretary’s safety rules and other laws as if the carrier owned them. The Secretary must make rules that any such agreement also say in writing who is responsible for loading and unloading the property.
