With the Board’s approval, carriers under subchapter I of chapter 135 (except those that move household goods) and shippers may agree to settle claims that someone was overcharged or undercharged because of wrong tariff terms or billing mistakes from failing to file or keep agreed rates, rules, or classifications under section 13702 (or, for transportation before January 1, 1996, sections 10761 and 10762 as of December 31, 1995). If they settle, the parties will not face penalties for departing from a tariff.
