The Surface Transportation Board can impose a civil fine on anyone it finds, after giving notice and a chance for a hearing, to have broken a transportation law under subchapter II of chapter 135. The Board gives the fine in writing and decides the amount by looking at what happened, how serious it was, and the person’s blame, past violations, ability to pay, and other justice-related factors. The Board can reduce, change, or cancel a fine anytime before it sends the case to the Attorney General. If a final fine is not paid, the Board may ask the Attorney General to collect it in federal court. A person can ask for a refund or cancellation within 1 year of payment if the Board finds the fine was unlawful, improper, or excessive.
