Federal rules about railroad safety and security must be the same across the country when possible. The Secretary of Transportation handles safety rules and the Secretary of Homeland Security handles security rules. States can keep or make laws on these topics until the relevant federal Secretary issues a rule on the same subject. States may also make extra or tougher local rules if they are needed to fix a local safety or security danger, do not conflict with federal rules, and do not unfairly block interstate trade. People can still bring state lawsuits for injury, death, or property damage when a party failed to follow the federal rule, failed to follow its own plan made under a federal rule, or failed to follow a state rule that is compatible with federal law. That rule about lawsuits applies to events on or after January 18, 2002. This does not create a new federal right to sue or automatically give federal courts jurisdiction over those state claims.
