Railroads that run intercity or commuter passenger trains must check their whole system and find each main-track spot where the speed drops by more than 20 miles per hour from the approach speed to a curve, bridge, or tunnel, and note the maximum allowed passenger speed at those spots. They had to finish that survey by March 3, 2016. Within 120 days after finishing a survey, the railroad must send the Secretary of Transportation an action plan that lists those locations, explains how the railroad will warn crews and enforce the speed limit (for example, changes to automatic train control or signals, more crew members or communication, signs, alerters, or other practices), gives milestones and target dates, and promises to ensure compliance. The Secretary must approve, approve with conditions, or disapprove the plan within 90 days of receiving it. Railroads must review the plan within 1 year after the Passenger Rail Expansion and Rail Safety Act of 2021 was enacted and then every year, and must send a revised plan at least 90 days before any big operational or territory change after consulting any host railroad. If a railroad did not exist when the FAST Act was enacted, it must survey routes within 90 days after the Passenger Rail Expansion and Rail Safety Act of 2021 was enacted and file a plan within 120 days after the survey. The Secretary can exempt track segments that have a certified positive train control system under section 20157 or other safety tech that gives equal or better protection. No new intercity or commuter passenger service may start unless the railroad meets these requirements. The Secretary can also apply these rules to other track segments at high risk of overspeed derailment.
