Railroad companies may offer sleeping spaces like crew bunks, camp cars, or trailers only if those spaces are clean, safe, and sanitary. The spaces must let workers rest without being disturbed by noise the railroad controls, and must have indoor toilets, drinkable water, and other features that protect health. Railroads may not start building or rebuilding such sleeping places after July 7, 1976 in areas near railroad switching or humping operations, as defined by rules from the Secretary of Transportation. Any railroad using camp cars had to retrofit or replace them by December 31, 2009. The Secretary of Transportation, working with the Secretary of Labor, had to write rules by April 1, 2010 and require camp cars to meet those rules by December 31, 2010. The Secretary will check compliance, can ban any camp car that does not meet the rules, and can fine carriers under federal penalty law (chapter 213).
