Amtrak must use the financial and performance metrics from section 207 to review each long-distance route every year. For 2008, Amtrak must sort every long-distance route into the top third, the middle third, or the bottom third. Amtrak must post a plan on its website to improve finances and operations for these routes. The plan must cover things like on-time performance, schedules/frequency/routes/stops, possible conversion to connected corridors, equipment and capital fixes, onboard services (food, first class, sleeping cars), State or other non‑Federal funding, expected Federal funding, ways to improve finances, and other factors that affect route performance. Amtrak must start carrying out the plan in fiscal year 2010 for the worst third, fiscal year 2011 for the middle third, and fiscal year 2012 for the best third. The Federal Railroad Administration will monitor the plans and results. If the FRA finds Amtrak is not making reasonable progress or misses outcomes for any calendar year, the FRA must notify Amtrak, the Inspector General of the Department of Transportation, the House Committee on Transportation and Infrastructure, and the Senate Committee on Commerce, Science, and Transportation, give Amtrak a hearing, and may withhold appropriated operating funds for routes in the worst third that are not making progress, except funds for passenger safety or security.
