Employers and employees must follow the Secretary of Transportation’s safety rules for commercial trucks and buses that apply to their work. Two or more carriers, employers, or people may not use common ownership, management, control, or family ties to dodge those rules or to hide violations or a history of violations. If the Secretary finds a pattern of dodging or hiding noncompliance, the Secretary may withhold, suspend, change, or cancel part of their registration under sections 13905 or 31134 and must consider that noncompliance when setting civil penalties under section 521(b)(2)(D). If an officer is found, after notice and a chance to be heard, to have led or helped such conduct, the Secretary may suspend, change, or cancel that officer’s individual registration under section 13902 or 31134. The Secretary must write rules to carry out these anti-evasion standards within 1 year after this subsection was enacted. Motor carrier — meaning given in section 13102. Officer — an owner, director, CEO, COO, CFO, safety director, vehicle maintenance supervisor, driver supervisor, or anyone who controls a motor carrier’s operations.
