Title 49 › SUBTITLE VI — MOTOR VEHICLE AND DRIVER PROGRAMS › PART B — COMMERCIAL › CHAPTER 313 — COMMERCIAL MOTOR VEHICLE OPERATORS › § 31306a
Creates a national database that must be up and running no later than 2 years after the Safe Roads Act of 2012 is passed. The database will hold records about commercial drivers’ positive alcohol or drug tests, test refusals, and related violations. It must let authorized users send and get records electronically and must be run securely (authentication, data storage, access controls, archiving, and alerts). The goal is to help employers follow federal alcohol and drug testing rules and to make roads safer. The Secretary of Transportation can hire a qualified private company to run the system and charge reasonable fees to users, but not to drivers who request their own records. The system must follow federal privacy rules and use standard formats for requests and for notices to drivers. Beginning 30 days after the database starts, medical review officers, employers, service agents, and others must report positive tests, refusals, and other covered violations. Employers must check the database before hiring and each year while a driver is employed. For hiring, employers must look back 3 years to see whether a driver had a positive test or refusal and, if so, whether the driver completed the required return-to-duty steps. The database will keep most records for 5 years, then remove them unless return-to-duty or follow-up obligations remain. The Secretary must notify drivers when records are added, changed, or released. Misuse can lead to civil and criminal penalties. Key defined terms used in the rules include: authorized user (who may access the database), chief commercial driver’s licensing official (state CDL official), clearinghouse (the database), commercial motor vehicle operator (a CDL holder subject to testing), employer, medical review officer (doctor who reviews tests), Secretary (Transportation Secretary), service agent (testing helper), and testing program (the federal alcohol and drug testing rules).
