The Transportation Secretary must make rules for bumpers on passenger vehicles and can also make rules for bumper parts made in or brought into the United States. The rules do not apply to vehicles or parts that are made only to be sent out of the country, are clearly labeled for export, and are actually exported. The rules cannot clash with other federal vehicle-safety rules, set a fixed dollar amount for repair costs, and should not, as much as possible, stop using a detachable hitch. The Secretary can exempt certain vehicles (like multipurpose vehicles, special-use models, or vehicles with a pending exemption request). When making rules, the Secretary must try to keep public costs low by weighing costs and benefits, insurance and legal costs, time lost, and health and safety (including emissions). People must be allowed to give written and oral input, and the Secretary must keep transcripts. A rule’s effective date must be set between when it is made and up to 18 months later, unless a later date is explained to Congress. The Secretary must also do needed research.
