The Secretary of Transportation can inspect or investigate when needed to enforce these rules. The Secretary must work with state and local officials and may tell the Attorney General about any violations. A person the Secretary designates, after showing ID and giving written notice to the owner or person in charge, may enter and inspect commercial places where vehicles or vehicle parts are made, sold, stored, fixed, or serviced. They may also enter private places if they reasonably believe a vehicle or part there breaks the rules. They can inspect the vehicle or part and may hold it for up to 72 hours for inspection. Inspections must be done at a reasonable time, in a reasonable way, and quickly. Written notice can be a warrant. If an impoundment causes loss of use or lowers value, the Secretary must pay reasonable compensation, except for vehicles covered by subchapter I of chapter 135. To check compliance, the Secretary can require dealers or distributors to keep records, give specified information if the Secretary explains why and what is needed, and let officials inspect those records. The Secretary may also inspect and copy records of anyone at reasonable times, order written reports or sworn answers, hold hearings, take testimony, and require witnesses and documents by legal order (subpoena). A summoned witness gets the same fees and travel pay as in a federal court. The Secretary can ask a federal court in the district where the agency action is happening to enforce subpoenas or orders; the court can treat disobedience as contempt. It is illegal to refuse to keep records, refuse access or copying, fail to give reports or information, refuse entry or inspection, or refuse impoundment when required.
