People must follow this chapter and the rules and orders made under it. Failing to do so is a violation, except for the rules and orders under sections 32902, 32903, 32908(b), 32917(b), and 32918. The Secretary of Transportation must hold a formal proceeding with a chance for a recorded hearing to decide if someone broke the rules. Anyone interested may take part. If a car maker does not meet the average fuel economy standard in section 32902 (after using credits allowed by section 32903), the Secretary must hold the same kind of proceeding when calculations under section 32904(c) show a violation. The Secretary will not hold the proceeding if later tests, calculations, or other information show no violation. The results must be published in the Federal Register, and anyone interested may participate.
