If someone does not pay a civil penalty after it is final — either as an order by the Secretary of Transportation or as a judgment by a U.S. court of appeals — the Attorney General must sue in a federal district court to collect it. That court may not reexamine the original final order. If an auto manufacturer goes bankrupt or is insolvent, a creditor who gave credit before the final judgment has priority over the United States for a penalty under section 32912(b), without applying section 32913(b)(1) and (2), in a collection action under subsection (a).
