The Secretary of Transportation can make a person pay a civil fine after giving them notice and a chance for a hearing if they broke a law the Secretary enforces through the Maritime Administrator or the Coast Guard, or a rule under that law. The Secretary sends the fine amount in writing. When picking the amount, the Secretary must consider what happened, how serious it was, how much the person is to blame, any past violations, ability to pay, and other fair factors. Before sending the case to the Attorney General, the Secretary may settle, reduce, or cancel a fine. If a final fine is not paid, the Secretary can send it to the Attorney General to collect in a U.S. district court. A person may ask for a refund within one year of paying, and the Secretary can refund the money if the fine was unlawful, improper, or excessive.
