Courts can review actions by the Secretary of Transportation when the Secretary is carrying out duties or powers moved under the Department of Transportation Act (Public Law 89–670, 80 Stat. 931). The same rule covers the Administrators of the Federal Railroad Administration, the Federal Motor Carrier Safety Administration, and the Federal Aviation Administration for duties the Act gave them. Any rules about notice, a chance for a hearing, acting on the record, or administrative review that applied before the move still apply now. This does not cover duties moved from the Interstate Commerce Commission to the Secretary under section 6(e)(1)–(4) and (6)(A) of the Act.
