The Secretary of Transportation or the head of a Department of Transportation unit must collect a toxicology sample from an officer or employee as soon as possible after an accident or incident and should try to do it within 4 hours. Each unit head must report to the Secretary how long it took and the circumstances when the test was tied to an accident or incident the National Transportation Safety Board is investigating. An officer or employee cannot use a failure to follow these timing rules as a legal claim or as a defense in court or an administrative case.
