A U.S. citizen can apply to the Secretary of Transportation for a certificate to operate only cargo flights. The application must follow the form and information the Secretary requires. The Secretary must issue the certificate within 180 days unless the applicant cannot provide the requested cargo service or follow the Secretary’s rules. The Secretary can add reasonable conditions to the certificate but cannot limit the places the carrier serves or the prices it charges. A certificate holder is excused from certain legal requirements the Secretary identifies and is treated as an air carrier except where those exemptions apply.
