The Secretary of Transportation can limit how charter airlines operate, but only when needed for the public interest and not more strictly than the rules that were in effect on October 1, 1978. Airlines (including indirect carriers) may not run regularly scheduled charter flights on planes with more than 9 passenger seats to or from an airport that does not have an FAA part 139 airport operating certificate, or to a reliever airport that is listed in the national plan and is within 20 nautical miles (22 statute miles) of three or more airports that each handle at least 1 percent of U.S. passenger boardings (and at least two of those airports are run by the reliever airport’s sponsor. “Regularly scheduled charter” does not include flights whose time and places are specifically negotiated with a customer. The rule in this paragraph does not apply to airports in Alaska or airports outside the United States, and the Secretary can waive the reliever-airport rule if needed for the public interest. A carrier with a certificate under section 41102 may offer charter flights within Alaska only if the Secretary finds the service is required by public convenience and necessity; the Secretary can make that finding when issuing or changing the carrier’s certificate. One exception is for a U.S. citizen who, before July 1, 1977, had a main business in Alaska and ran flights there with aircraft over 40,000 pounds gross takeoff weight. If a carrier fails to follow the rules in sections 41110(e) and 41112 (or related orders), the Secretary can immediately suspend part of the carrier’s certificate for up to 30 days without notice or a hearing, start a hearing right away, and extend suspensions up to a total of 60 more days while the hearing is pending. If the carrier is later found to be complying, the Secretary can end the suspension at once, but may still levy civil penalties.
