Title 49 › Subtitle SUBTITLE VII— AVIATION PROGRAMS › Part A— AIR COMMERCE AND SAFETY › Subpart ii— economic regulation › Chapter 417— OPERATIONS OF CARRIERS › Subchapter I— REQUIREMENTS › § 41719
Air carriers must give the Secretary of Transportation at least 45 days' notice before they stop interstate flights from a nonhub airport that is on the Secretary’s current list. No notice is needed for sudden emergencies (like bad weather, equipment failure, or strikes). No notice is needed if the change is only seasonal, if the carrier has served the airport 180 days or less, if another airport in the same community keeps jet service, or if another carrier or a change in aircraft keeps service running without a break. By January 1, 1995, the Secretary must set rules about when regional/commuter carriers can be excused from the notice rule. Part 121 air carrier — an airline that follows FAA part 121 rules. Part 135 air carrier — an airline that follows FAA part 135 rules. Regional/commuter carrier — a part 135 carrier or a part 121 carrier using planes with 70 seats or fewer. Termination — stopping all service at an airport.
